Terms of Service

1. The service

CarMagics turns vehicle photos you provide into enhanced photos and short computer-generated video commercials and window stickers, and fills in vehicle details from a VIN. Features may change as we improve the service. Features described as "coming soon" are not part of what you buy until they are released.

2. Accounts

• You must provide a valid email address and keep access to it secure. You are responsible for activity on your account.
• You must be at least 18 years old, or the age of majority where you live, and able to enter a binding contract. If you use CarMagics for a business, you confirm you are authorized to bind that business.

3. Free tier and packages

• Free: each account may try one car, with its two photos (front and rear) on a showroom background and 1 commercial video carrying a CarMagics watermark.
• Single cars are one-time purchases; unused ones never expire. The Dealer Package is a monthly subscription: it renews automatically each month at the price shown until you cancel, includes 12 cars per month, and unused cars do not carry over. You can cancel anytime from Billing on your account; cancellation takes effect at the end of the current paid month. Each car you unlock includes 1 commercial video, 1 salesperson walkaround video and its two photos (front and rear) on a showroom background, without a watermark. Unlocked allowances belong to that car and cannot be moved to another car.
• Videos that fail are not counted against your allowance; you can simply try again.
• A video that completes counts toward that car's allowance. If a completed result has a clear technical defect (for example a corrupted file, the wrong vehicle, or a visibly distorted vehicle), contact us within 14 days and we will redo it at no charge.
• Want a different scene after a car's commercial is made? A second commercial is an optional $5 for that car (no package needed, no watermark), and you confirm the scene before paying. Genuine technical defects are fixed free as described above.
• If you unlock your free car with a package, its free commercial is delivered again without the watermark and with your branding (no new commercial is made), and the car also gets a salesperson walkaround.
• Delivery times are estimates and can vary with demand. Paid cars use our fast lane when available.
• Prices are shown before checkout and charged by Stripe. Taxes may apply. Refunds follow our Refund Policy.

4. Your content and acceptable use

• Upload only photos you own or have permission to use, of vehicles you are entitled to market.
• Do not upload unlawful, infringing, deceptive or offensive content, images that identify private individuals without permission, or anything you do not have the right to share.
• Do not use CarMagics to create misleading advertisements, misrepresent a vehicle's condition, features or price, or violate advertising, consumer protection or dealer regulations.
• Do not attempt to reverse engineer, overload, scrape or disrupt the service, or share accounts to avoid limits.

5. Ownership and license

• You keep ownership of the photos you upload. You give us a limited license to process and store them only to provide the service to you.
• Subject to these terms and payment, you may use the enhanced photos and videos created for your account for personal and commercial purposes, including advertising and social media. Free videos must keep the CarMagics watermark.
• CarMagics, its logo, website, software, scenes, backgrounds and templates remain our property. Scene and background imagery is licensed to you only as part of the content generated for you.

6. Generated content

Results are generated automatically by software and may contain inaccuracies or visual artifacts. We design the service to keep the vehicle as photographed, but you are responsible for reviewing every result before publishing and for ensuring it accurately represents the vehicle. Do not rely on generated content as a description of a vehicle's condition. License plates are obscured on a best-effort basis; check before publishing.

• Made with AI. Backgrounds, scenes, camera moves and presenters are created with artificial intelligence. Some platforms (for example Meta, TikTok and YouTube) ask you to label AI-generated or AI-edited content; follow their rules when you post.
• Presenters are AI characters. The salespeople in walkaround videos are computer-generated characters, not real people. Do not present them as your employees or as real customers.
• Music and sound. The music and sound effects in your videos are licensed for use as part of that video, including in ads. You may not extract them and use them separately.
• Window stickers. The window sticker is a marketing document built from the details you enter and the VIN decode. It is not a Monroney label and does not replace any label or disclosure required by law; check every detail before you print it.

7. Third-party services

Payments are processed by Stripe and VIN data is provided by third parties. Their terms may also apply. We are not responsible for third-party services or data accuracy.

8. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by law. We do not guarantee any sales, views or other marketing results.

9. Limitation of liability

To the extent permitted by law, CarMagics will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits or data. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim.

10. Indemnity

You agree to indemnify CarMagics against claims arising from content you upload, your use of generated content, or your violation of these terms or the law.

11. Suspension and termination

You may stop using CarMagics at any time. We may suspend or terminate accounts that violate these terms or put the service or others at risk. If we discontinue the service, we will give reasonable notice and refund unused, unlocked-car purchases made in the prior 90 days.

12. Changes to these terms

We may update these terms. We will post the new version with a new effective date and notify account holders of material changes. Continued use after changes take effect means you accept them.

13. Governing law

These terms are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us first so we can try to resolve it informally.

14. Copyright complaints

If you believe content on CarMagics infringes your copyright, email [email protected] with: your contact details, a description of the work, the link or location of the content, a statement that you believe in good faith the use is not authorized, a statement that the information is accurate, and your physical or electronic signature. We respond promptly and remove content where appropriate. Repeat infringers lose access to the service.
